Mock Stars Gloucestershire (“Our”, “Us” and “We”) - Terms and Conditions of Sale and Booking

Please note: we reserve the right to review these terms and conditions at any time.

CONDITIONS OF SALE:

Tickets
Bookings are non-transferable to any other individual other than the pupil named on the ticket.
Tickets will be supplied by email and include useful information about test day. Tickets are your proof of purchase but are not required for entry, your booking is in your child's name

Test and Reports
You understand and accept that completing a Mock Stars 11+ test(s) does not guarantee entry to a grammar or independent school.

All statistics provided after the test(s) are only given as guidelines and do not constitute a guarantee of any kind.

Mock Stars will endeavour to send results out approximately one week after completion of the test(s). If results are not received after 14 days, then it is an individual’s responsibility who booked the test(s) to make the necessary enquiries.

Feedback Reports will only be sent to the email address supplied on the booking form; this contact can only be changed with the express consent of the named person booking used to create the online account. Please bear this in mind if you book on behalf of another parent and child.

Please note that you will not receive a copy of the test paper or answer booklet. We ensure that each test reflects the latest information we have available regarding current eleven plus exams for Gloucestershire grammar schools. In order to protect our IPR, the test paper cannot be given to parents. All questions are written by Mock Stars and are based on findings from detailed research.

Children should bring their own pencils and rubbers. Children are able to store bags or other equipment under their chairs in the exam rooms. Children will be allowed to bring non-nut product snacks for the break and children may bring their own water bottle.

Health and Safety
When completing the booking form, you must ensure that a parent/guardian or responsible person is entrusted with dropping off and collecting their child from the venue and that the child is aware and familiar with the adult who will be collecting them.

You must ensure that you provide an accurate contact number(s), in case of an emergency and update us of any change to contact details.

You must disclose any medical conditions or special educational needs that we need to be made aware of, in order to assess whether we can accommodate your child. This information must be disclosed at the time of booking. If in doubt email us before booking.

In case of allergy, we cannot guarantee that your child would not be exposed to (an) allergen, although we will always take reasonable precautions where notified.

Additional Test Requirements
Please note that we may be unable to accommodate children who need extra time or a separate room for their test as they will usually need to be invigilated separately. However, please enquire if this will be possible prior to booking, pupils will be accommodated on a case-by-case basis and may be subject to additional charges. We endeavour to accommodate every child where possible but are dependent on the limitations of our hire arrangements and staff numbers.

Refund, Exchange and Cancellation Policy

Please contact us by email regarding any required changes to bookings.

We regret that no changes to exam sessions can be made within 14 days of the exam date and no refunds will be given.

If your child is unable to attend an exam, we will endeavor to transfer your booking to a future date exam, but this is entirely dependent on availability and may be subject to an administration charge. 

If for any reason we cannot hold an event, due to situations that are beyond the control of Mock Stars Glos, a refund will be provided minus the administration fee.

Exam entry
Arrivals after the published start time will not be admitted. No refunds will be given.

COVID 19
Parents should not bring their child to our Centre if their child or any member of the house has exhibited coronavirus symptoms. We will endeavour to re-allocate your child’s space to a different session but this is entirely dependent on availability.

All desks and equipment will be disinfected before and after each test session.

VAT
Mock exam prices shown on our website include Value Added Tax (VAT), which is payable by all customers within the EU. If you are resident outside the EU you will be exempt from VAT if you are able to provide evidence of your residency.

Mock Stars Online Box Office - Terms and Conditions of Sale and Booking

1. Use of the Online Box Office 
a. These terms and conditions (“Terms”) apply to tickets sold through Our online box office (“Website”). Please read these Terms carefully before placing your order. You acknowledge that by purchase you agree to be bound by these Terms. If you do not accept these Terms, you must not place an order for any of the tickets through the Website.
b. The information contained in this Website has been prepared solely for the purpose of providing information about our mock tests and making online bookings for these tests and must not be used for any other purpose.
c. By accessing this site, you will be assuming all risks associated with the use of this site, including risk of your computer, software or data being damaged by any virus which might be transmitted or activated via Our Website or your access to it.
d. You will only use this Website for personal private use.

2. Orders and Payment
a. The published price of the ticket (“Price”) includes any applicable taxes and booking or collection fees.
b. You acknowledge and agree that the Price may be subject to change and variation from time to time.
c. You shall pay for the tickets using one of the methods specified on the Website.  Your Order shall not be placed until we have received your payment.
d. Your Order constitutes an offer to Us to buy Tickets. All Orders are subject to acceptance by Us, and We will confirm such acceptance to you by sending you an e-mail attaching your Tickets subject to the Order (“Order Confirmation”). The contract between us will only be formed when We send you the Order Confirmation (“Contract”).
e. It is your responsibility to check the Tickets that are subject to your Order and We are under no obligation to rectify any mistakes once the Contract has been formed in accordance with clause 2d above.
f. We will not be responsible for any tickets that are lost, stolen or destroyed.

3. Delivery
Tickets will be supplied by email.

4. Refunds and Exchanges
a. You are only able to receive a refund for a cancelled Order up to 14 days after it has been accepted by Us, after this time you are not entitled to a refund for any tickets purchased by you, even if you are unable to attend the event. The cancellation rights contained in the Consumer Protection (Distance Selling) Regulation 2000 (as amended) do not apply to the sale of Tickets.
b. From 14 days after an Order, if your child is unable to attend the exam, we will endeavour to transfer your booking to a future date exam, but this is entirely dependent on availability and may be subject to an administration charge. 
c. If the event is cancelled or rescheduled by Us you will be entitled to a refund of the Price, less any administration charges. Refunds must be claimed within 1 month from the date of the event.
d.  We will use reasonable endeavours to notify you if an event is cancelled or rescheduled, but you acknowledge and agree that it is your responsibility to check whether an event has been cancelled or rescheduled and we have no liability for any failure to notify you.

5. Conditions of admission
a. You shall comply with all policies, procedures and safety announcements in force at the venue at which the test is to be held, including any security procedures in place from time to time. 
b. Where any pupil arrives in poor health, falls ill during the duration of the exam or shows signs of extreme anxiety which, in our opinion, is a health and well-being concern, we reserve the right to request pupils to leave the exam (pupils would remain accompanied at all times until pick up). In this instance we would call the pupil’s emergency contact number (as provided by you for a parent, carer or responsible adult). This process is in place for health and safety of all pupils and to ensure the exam can proceed without undue interruption.
c. Where any extreme or concerning behaviours occur, we reserve the right to request pupils to leave the exam (pupils would remain accompanied at all times until pick up). In this instance we would call the pupil’s emergency contact number (as provided by you for a parent, carer or responsible adult). This process is in place for health and safety of all pupils and to ensure the exam can proceed without undue interruption.
e. You should retain your ticket for your records as proof of purchase.
f. Animals are not permitted within the venue, with the exception of assistance dogs.

6. Accuracy
We use reasonable endeavours to ensure that the information contained on the Website is correct at time of being published. We reserve the right to make alterations.

7. Data Protection
We process your personal data in accordance with all applicable data protection laws, as set out in our Privacy Notice.

8. Limitation of Liability
a. If We fail to comply with these Terms, we shall only be liable to you for the Price of the tickets and, subject to clause 9b, any loss you suffer that is a foreseeable result of Our breach of these Terms or our negligence, but We are not responsible for any loss, damages, costs or expenses you suffer which were not reasonably foreseeable to be incurred by you and could not have been reasonably foreseeable by you or Us on entering these Terms.  Loss or damage is foreseeable if they were an obvious consequence of Our breach or if they were contemplated by you and Us at the time We entered into this Contract.
b. We only supply tickets for private use. You agree not to use the tickets for any business or re-sale purposes and, notwithstanding clause 9a, We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity, howsoever arising.
c. We do not in any way exclude or limit Our liability for:
i. death or personal injury caused by Our negligence;
ii. fraud or fraudulent misrepresentation;
iii. any breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession); 
iv. any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples);
v. any other matter for which it would be illegal for Us to exclude or attempt to exclude Our liability.

9. Variation Of The Terms
We have the right to revise and amend these Terms from time to time, including but not limited to making changes to reflect current market conditions affecting our business, changes in technology, changes in payment methods and changes in relevant laws and regulatory requirements. 

10. General
a. If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law.
b. These Terms and any document expressly referred to in them represent the entire agreement between you and Us in respect of your use of the Website and your use of the Tickets, and shall supersede any prior agreement, understanding or arrangement between you and Us, whether oral or in writing.
c. You acknowledge that in entering into these Terms, you have not relied on any representations, undertaking or promise given by or implied from anything said or written whether on the Website, the internet or in negotiation between you and Us except as expressly set out in these Terms.
d. These Terms are governed by and construed in accordance with English law. The Courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of these Terms.
